3. Use of the Services
Magink provides AI-powered story creation and reading tools for children. You agree to use the Services only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You may not: circumvent security or access restrictions; reverse-engineer or extract source code; resell, sublicense, or commercially exploit the Services without permission; use the Services to harm minors or collect their data improperly; or use the Services in any way that violates applicable law.
4. Subscriptions and Payments
Some features require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions typically renew automatically unless cancelled before the renewal date. Refunds are handled according to the policies of the App Store or Google Play. We reserve the right to change pricing with reasonable notice.
5. Intellectual Property
Magink and its licensors own all rights in the Services, including software, design, trademarks, and content (except user-generated content). You retain ownership of content you create. By submitting content, you grant Magink a non-exclusive, worldwide, royalty-free license to use, store, display, and process such content to provide and improve the Services.
6. AI-Generated Content
Stories and other content generated by our AI are provided for personal, non-commercial use. Magink does not guarantee the accuracy, appropriateness, or originality of AI output. You are responsible for reviewing content before sharing it with children. We may use anonymized data from your interactions to improve our AI models.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. USE IS AT YOUR OWN RISK.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGINK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold Magink harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Services, your content, or your violation of these Terms.
10. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason. You may stop using the Services at any time. Upon termination, your right to use the Services ceases. Provisions that by their nature should survive (e.g., IP, disclaimers, limitations of liability) will survive.
11. Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which Magink operates, without regard to conflict of law principles. Disputes shall be resolved through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration or courts as permitted by applicable law.
12. Changes
We may modify these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance. If you do not agree, you must stop using the Services.
